Copyright & IP Policy

1. Purpose of This Policy

This Copyright & Intellectual Property Policy ("Policy") explains how intellectual property rights are handled on DAILY. It describes: the intellectual property owned by DAILY; the ownership and licensing of content submitted by users; your obligations to respect the intellectual property rights of others; how to report suspected copyright or trademark infringement; how we respond to such reports; and how users may dispute a removal they believe was made in error. This Policy forms part of our Terms of Service.

2. DAILY's Intellectual Property

2.1 Ownership

DAILY's developer, together with its licensors, owns all right, title, and interest in and to the following, and all intellectual property rights therein:

  • The DAILY mobile application itself, including its compiled and source code
  • The DAILY name, brand, and associated logos
  • The user interface, visual design, layout, and design elements of the App
  • The underlying software architecture, algorithms, and technical infrastructure supporting the Service
  • Any documentation, marketing materials, and other original works created by DAILY in connection with the Service

2.2 No Transfer of Rights

These materials (collectively, "DAILY IP") are protected by applicable copyright, trademark, trade secret, and other intellectual property laws in Lithuania, the European Union, and other jurisdictions. Except for the limited, revocable, non-exclusive license to access and use the Service for its intended personal purposes as set out in our Terms of Service, nothing in these documents transfers any right, title, or interest in the DAILY IP to you.

2.3 Restrictions

You may not, without our prior written consent: copy, modify, distribute, publicly display, publicly perform, sell, lease, rent, sublicense, or create derivative works based on the DAILY IP; reverse-engineer, decompile, or disassemble any part of the Service; remove or alter any proprietary notices on the Service; or use the DAILY name, logo, or branding in a manner likely to cause confusion as to source, sponsorship, or endorsement.

3. Ownership of User Content

3.1 You Retain Ownership

As between you and DAILY, you retain ownership of all intellectual property rights in the photos, captions, comments, and other content you submit to the Service ("User Content"). We do not claim ownership of your User Content.

3.2 License You Grant to DAILY

By submitting User Content, you grant DAILY a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your User Content solely as necessary to operate, provide, and improve the Service, as more fully described in our Terms of Service. This license does not grant DAILY any ownership interest in your User Content.

3.3 License Among Users

When you post content that is visible to other users (such as a photo shared publicly on your profile), you grant those users a limited license to view that content within the App, consistent with the App's intended social functionality. This does not permit other users to copy, redistribute, or otherwise use your content outside of the App without your separate permission.

4. Your Obligation to Respect Third-Party Rights

You may only upload, post, or otherwise submit content to DAILY that you own, or that you have obtained the necessary rights, licenses, consents, and permissions to use and to share on a platform like DAILY. This includes ensuring that you have appropriate rights to:

  • Photographs you did not personally take
  • Artwork, illustrations, or designs created by others
  • Any identifiable third party appearing in your content, to the extent required by applicable law
  • Any music, audio, or other copyrighted material that may be visually referenced or incorporated into your content

Uploading content that infringes the intellectual property rights of a third party is a violation of our Terms of Service and Community Guidelines, and may result in content removal and enforcement action against your account, as described in Section 6 below.

5. Reporting Copyright Infringement

5.1 How to Submit a Report

If you believe that content available on DAILY infringes your copyright, or the copyright of a person or entity you are authorized to represent, you may submit a report to us at support@dailyemoji.app. To help us investigate your report efficiently, please include the following information:

  • Identification of the copyrighted work you believe has been infringed, including a description sufficient for us to locate it
  • Identification of the allegedly infringing content on DAILY, including specific information such as the username, post link, or other details sufficient for us to locate the material
  • Your contact information, including your name and email address
  • A statement of good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information provided in your report is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

5.2 Incomplete Reports

Reports that do not contain sufficient information for us to investigate and act upon may be rejected or may result in delayed processing. We may follow up with you to request additional information.

6. Our Response to Infringement Reports

6.1 Review Process

Upon receiving a report that reasonably appears to satisfy the requirements of Section 5, we will review the reported content in accordance with our Content Moderation Policy. This may involve both automated analysis and human administrator review, consistent with our general moderation process.

6.2 Possible Outcomes

Where we determine, following review, that content likely infringes a third party's intellectual property rights, we may remove or disable access to the reported content. We may also notify the user who posted the content that it has been removed and the reason for removal, where appropriate.

6.3 Repeat Infringers

We reserve the right to suspend or permanently terminate the accounts of users who are found to have repeatedly infringed the intellectual property rights of others, consistent with our Terms of Service and Content Moderation Policy.

7. Counter-Notifications and Disputing a Removal

If you believe that your content was removed as a result of a mistake or misidentification, or that you had the necessary rights to post the content in question, you may submit a counter-notification to support@dailyemoji.app. To help us review your dispute, please include:

  • Identification of the specific content that was removed and its prior location on the Service
  • A statement, made under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification
  • Your name, contact information, and a statement that you consent to the jurisdiction described in our Terms of Service with respect to any legal action arising from your counter-notification
  • Your physical or electronic signature

We will review counter-notifications and may, at our discretion and where appropriate under applicable law, restore the disputed content.

8. Trademarks

"DAILY" and any associated logos, icons, and brand elements are trademarks, trade names, or trade dress of DAILY's developer, whether or not they appear with a trademark symbol. You may not use these marks in connection with any product or service that is not affiliated with DAILY, or in any manner that is likely to cause confusion among users, without our prior written permission. Nothing in this Policy grants you any right to use DAILY's trademarks except as expressly permitted for the limited purpose of accurately referring to the Service (for example, in a factual review or news article).

9. Trademark Infringement Reports

If you believe that content on DAILY infringes your trademark rights, you may submit a report following a process substantially similar to that described in Section 5, providing sufficient detail about your trademark rights and the allegedly infringing use for us to investigate.

10. Third-Party Intellectual Property

DAILY relies on certain third-party services and technologies, including those provided by Supabase, Apple, and Google, in connection with the operation of the Service. Any intellectual property rights owned by these third parties remain their exclusive property, and nothing in this Policy or our Terms of Service transfers any such rights to you or to DAILY.

11. Disclaimer Regarding User Disputes

DAILY is not in a position to adjudicate intellectual property disputes between users, and our decisions regarding content removal or restoration under this Policy reflect our own internal review process, not a binding legal determination of intellectual property rights. Parties involved in a genuine intellectual property dispute may need to pursue that dispute through appropriate legal channels independent of DAILY.

12. Relationship to Other Policies

This Policy should be read together with our Terms of Service (which governs the overall license granted for User Content) and our Content Moderation Policy (which governs how reports and flagged content are reviewed and actioned).

13. Changes to This Policy

We may update this Copyright & Intellectual Property Policy from time to time to reflect changes in our practices or applicable law. Material changes will be communicated through the App.
